Generally two years from the crash (Cal. Code Civ. Proc. § 335.1). If a city, county or state agency is involved, a claim may need to be filed within six months to preserve your right to recover for your injuries, damages, etc;
California uses pure comparative fault. This means that you can still recover for your injuries and damages, but the amount awarded will be reduced by your share of fault.
Under Proposition 213 (California Civil Code § 3333.4), an uninsured motorist generally cannot recover non-economic damages, such as pain and suffering, from the at-fault driver. However, you can still recover economic damages, including medical bills, lost wages and property damage. An important exception applies if the at-fault driver was convicted of DUI in connection with the crash, in which case you may still recover non-economic damages.
California requires helmets (CVC § 27803). Not wearing a helmet may reduce recovery for any head injuries, but it does not bar your claim for other injuries, damages, etc;
There is absolutely no upfront cost to you. We do not collect a legal fee unless or until a recovery is made.
